EDUCATION ADVOCACY FOR CHILDREN IN CARE: STUDENT TRIBUNAL HEARING TRAINING

About The Program:
This CLE trains attorneys to represent students who are facing public school disciplinary hearings. Under Georgia law, K-12 public school students faced with proposed out of school suspension of more than ten days or with expulsion, are entitled to dispute the proposed disciplinary action at an administrative hearing often referred to as a 'tribunal.' Because of the impact a long term suspension or expulsion may have on a student's academic success and on the flow to the “school to prison pipeline,” it is important that the tribunal process provide meaningful due process to a student. Public school students in foster care sometimes face a disciplinary hearing alone. Attorneys completing the CLE may opt to enter a pool of trained volunteers to provide tribunal representation to a child in foster care. To accomplish this, Georgia Appleseed has created a protocol in collaboration with Georgia Division of Family and Children Services (DFCS) and the Georgia Office of the Child Advocate (OCA) to identify students in need of assistance and match them with an attorney.
